Then we should just start invalidation proceedings.

There's a fee of £200, just stick up a donation thread and get people to donate until we hit the mark. There's no time limit on invalidation, and we don't have to represent LOMCN or lom.com, invalidation can be sought via a community such as us to have the trademark simply removed due to the circumstances in which the name is used.

It's really stupid what this kid's done, because it's very easily challenged and there's no possible way that he can justify having used the name under class 09 prior to.. well... LOMCN? lol.
I'm currently challangeing "Jamie" aka Lapta over the age of the files that he has in current use and also challanging his hosting company as well. I've sent in file that are all coded under DSUK and are all time stamped to around 4 years ago, with recent modification of them.

I'm just waiting on a response back from them about this.

There is no need to challange him over the trademark "Legend of Mir" anyone can own a name for something, but with trademarking it has to be made clear on what you are trademarking and in his case all he has done is trademark the name and nothing else. He has to prove under the trademark that the name also includes files and other such things to which it doesn't.

This is where you can challange him.

Jamie has made so many mistakes with everything -
JDC Gaming is a soul trading company and registered in the United Kingdom.
There is no registered company in the UK called JDC Gaming and so would not be a soul trading company either.

Lapta for a 28 year old is thick as two short planks

i shall be going to blackpool at the end of the month for my m8s 25th, if some1 can vouch that i was never there and get me off the hook we will kidnap jamie, hit him with sticks until he cries for his mother then throw him in the sea.... :)

His trademark is clear. It's class 09 which is online gaming. Technically as he owns the trademark for that classification he could challenge anything in that given class with the name. Of course he wouldn't challenge LOMCN etc as he'd lose the case and lose the registration, but it doesn't stop him shooting down new servers as they come should they use that wording. It's not really an issue, as he'd never actually get into a legal battle about it - but he can provide the documentation to ISPs and hosting companies and have them close the service (as they don't understand the circumstance).

As for the sole tradership (aside from the fact he can't spell sole), you can't really report someone and have anything happen, aside from getting the tax man involved... but that's only really an issue in terms of VAT and smaller taxes, which you don't even have to declare unless you turnover a certain amount per annum. I don't think he'd be turning over enough, and I don't think it would cause him much hassle regardless.

Thats all he has done is provided the class 09 trademark, he can challange it under the class 09. But then has a legal battle on his hands if he does, as his class 09 doesn't clearly state in what context or to what level.

Unlike DSUK, everything is under a class 09 with description of what is covered by the trademark. Which happens to cover any server files that are created under the PGRCN GNU as well. He's clearly playing with fire that he can't put out and will get seriously burn if he continues.

As for being a sole trader, he is clearly stating that it's a registered company in the UK. Unfortuantly its not and never has been, I don't think he even knows how to go about doing this in all honesty. But because he is claiming to be a registered company in the UK, he is effectiverly commiting fraud.

On another note, anyone got an email address that actually works for lapta. As tried every single one I can find and no luck, as getting bounce back from the revenge ones.

that's it im going to order 50 pizzas and send them to his address :) don't it as a prank to my m8 when we were in Ibiza and they made him pay for it all lol, we paid him back thought as we felt harsh.

Can a Mod/Admin close this thread.

Solvant hasn't been very fourth coming with the information that has been supplied.

The server for the last 6 month was bought and paid for by Lapta aka JDC Gaming, yes it was wrong for Jamie to use his trademark as a way to get at solvant. But solvant should learn not to try and rip people off and pay for things themselves
