Well since you profit from P69 you ARE violating the trademark indefinately. You also ARE using their code, for at the very least the transmission of the server protocol.
Since the rest is 'emulated', and your not the one that did the reverse engineering... its a little murky, but the aforementioned still holds true.
Finally, from a publicity perspective your also the best pserver to target initially (being the largest)... thus sending a message and making furthur litigation unnessacery.

2a) The EULA of the original client may prohibit you from using it on any other server... I wouldn't know as ive never read it.
2b) Other clients which don't use the original material/files/protocol should be fine.
3) Server does not use any of the original code (your m2's use the same protocol as 1.4 MIR), dispite other files being 'emulated'.
Ideally... you want a completely written from scratch client and server, with fresh homemade graphic files. However if its still too like MIR you cannot make a profit as its trademark infrigement. Make it signifficantly different then its fine (and its prolly also a different game by then).

The complaint originates from Game Network who complained to one of our up-link carriers, who then forwarded the complaint to us.
I personally am aware of Legend of Mir as I have played it in the past. Server emulators are illegal. As such we require you to remove any and all traces of software that would enable a person to play Legend of Mir on your server unless you contact Game Network and acquire a license for the software.

see, WeMade are the brains behind the client and server software, Game Network is just another distributer, but Game Network has the same priviliges as WeMade since they bought the license, so in this case, you are FORCED to close down your server, your server along with many others are breaking many rules stated in the use of the internet it self, and the game's tos.
