I am glad you find it such a laughing matter.
As an ISP provider you have a legal obligation in accordance with Godfrey v
Demon Internet Limited case law to ensure that your customers do not engage
in the distribution of copyrighted owned products, and in this case your
website/dedicated server is illegally promoting a game that is owned by
ourselves.
Do you plan on taking any action? or do we have to go down the long legal
road?

I wouldn't worry about it to much, from speaking with your hosting company. They don't listen to inderviduals who threaten without the necessary proof or documentation to backup what they are saying, they also advised that they only take the necessary steps to remove information from there servers when legaly advised to and not from an email from a single person.

"Laurence Godfrey, a physics lecturer, learned that someone had posted a message to the Usenet discussion group soc.culture.thai. That message, sent by an unknown source, had been forged to appear to have been sent by Dr. Godfrey"

"Godfrey contacted Demon Internet, one of the major Internet Service Providers in the Great Britain to inform them of the forged message and ask that it be deleted from Demon Internet's Usenet news server."

Godfrey sued Demon Internet and thats that.

Anyone tell me what the fudge that has to do with hosting copyright information?

Lapta's a retard, if the hosting company actually look it up, combine it with his posts which look like they're from an emo raging 10 year old, then I'm sure they'll wonder what he's been taking.

Solvent I would suggest changing hosting companys, Lapata has provided them with the registered trademark. Which you can see is above, I'm currently speaking with EUK Host about this.

The Trademark is owned by a company called JDC Gaming, which currently is not a registered trading company. So unless lapta can prove, by providing a vaild trading company number. His point of trying to get your server shut down, would not be a valid one.

I have raised this isue with EUK Host and made them aware of this.

Lapta is backing himself in to a hole, that he is currently digging himself.

Tbh you should write a letter to his dedi company and tell them that the files he is useing is illegal and has been told by gnonline to close down the server. :)

I've opened up a disscusion in the Mod Section regarding this. Does seem that his actions arn't really in the spirit of advancing the private server community.

Will let you know whats decided.

If this kid wants to get smart with UK trademark registration then LOMCN should challenge the registration. There's a grace period post registration, 2/3 months I believe in which the name is open for objection.

He'd lose all his registration fee, and would have to compensate us for any fees we incur during the process. It's an easy win as the domain registration is there, along with historical records of use of the term "Legend of Mir" prior and current to his registration. Else someone like scorpian could challenge it, having had a domain registered with that name for several years.

The capacity in which he has regsitered it is online gaming, which conflicts with both LOMCN and legendofmir.com, both which are sites owned by this or members of this community.

If he wants to try and fight the community then we should at least fight back.

Then we should just start invalidation proceedings.

There's a fee of £200, just stick up a donation thread and get people to donate until we hit the mark. There's no time limit on invalidation, and we don't have to represent LOMCN or lom.com, invalidation can be sought via a community such as us to have the trademark simply removed due to the circumstances in which the name is used.

It's really stupid what this kid's done, because it's very easily challenged and there's no possible way that he can justify having used the name under class 09 prior to.. well... LOMCN? lol.
